Domain Name Leasing Agreement
SUBJECT TO LEASE: The Lessor shall lease domains to Lessee as per stated terms.
PAYMENT TERMS: The
Lessee must make a monthly payment as priced. First Payment
must be made before the domain will be forwarded or name severs changed to
that of the lessee. Subsequent Monthly payments must be made on a
monthly interval, or the Lessor can change the name servers or change the
forwarding of the domain name away from the lessee.
LEASE TERM: This
lease will begin on the date indicated by the initial order, pending that
the first month payment is successfully made at the time of the order
which is the initiation of the open ended monthly subscription. At the end
of this lease, the lessee will have the first right to establish a new
lease.
APPROPRIATE USE
OF DOMAIN NAMES: The domain name may only be used by the lessee for legal and
appropriate uses, and the Lessee must comply with all laws and
regulations. Domains may not be used for any kind of adult content,
sale of firearms, sending spam or any other illegal or inappropriate
uses.
Name Servers: The
lessee can request to change the name servers up to a maximum of 1 request
per day or maximum of 5 requests per month. The lessor will make
reasonable effort to change the name servers within 24 hours of the name
server change request initiated by the lessee.
DOMAIN NAME
OWNERSHIP & STATUS: Domain name(s) are
considered independent property of lessor regardless of their involvement
with other websites or properties. The Lessor retains full title of
these domain names at all times. The Lessee must immediately advise
the Lessor of any levy, lien, claim or legal process issued against the
specified domain names.
DEFAULT RIGHTS: The
Lessor may legally take possession of the domain names and deduct all
recovery, restoration of reputation and associated costs without prior
notice if the Lessee is in default. In this case, the Lessee will be
responsible for any deficiency. These rights are cumulative. The
Lessor must release the domain names or mitigate any default damages if
legally required to do so.
DAMAGE TO
REPUTATION: The Lessee is responsible for any damage to the reputation of
the domain names, and agrees to return them to the Lessor undamaged. Any
illegal use, spamming or unreliability of operation or service of the
domain names are all examples but not limitations of damage to reputation.
DEFAULT: Any of
the following conditions constitutes a lease default:
The failure to
make a required payment within the specified timeframe.
The violation
of any other provision or requirement
The Lessee’s
insolvency or bankruptcy.
